LASUSU HIGH COURT GIVES JUDGMENT ON THE DISPUTES BETWEEN THE EXECUTIVES

The LASUSU High Court, on Monday, 25th February 2025, put an end to the battle between the suspended union members at the Moot Court, Lagos State University.

LASU Conscience recalls that on the 7th of February, 2025, the vice president was suspended on the grounds of rude conduct. Similarly, the legal director was also suspended on the 14th of February for misuse of office.

The LASUSU Vice President, Comrade Ramom Rihanat, and the Legal Director, Comrade Toheeb Alimi, were the plaintiffs, subject to their previous suspension by the Student Parliamentary Council (SPC), while the SPC was the defendant.

In the ruling, not all reliefs sought were granted, but the Court of Justice ruled in favor of the plaintiffs on the grounds that the procedures by which the SPC carried out the suspension were contrary to the provisions of the LASUSU Constitution and thus, the suspension was null and void ab initio.

The court ordered the immediate reinstatement of the suspended executive members, and damages in the sum of ₦10,000 were awarded to the legal director.

It further stated held that the appointment of an acting director from among the members of the Parliament was not only unlawful but also a flagrant violation of established procedures. The court also directed the SPC to pay a fine of ₦2,000 for failing to make an appearance in court.

This case further cements the supremacy of the law over everyone, including the Union and its members, and the independence possessed by the judiciary to interpret the law without external influences.
